1. Acceptance of Terms

By engaging The Blind Guyz LLC (“Company,” “we,” “us,” or “our”) for window treatment services, you (“Customer,” “you,” or “your”) agree to be bound by these Terms of Service. If you do not agree to these terms, please do not proceed with our services.

2. Services Provided

The Blind Guyz provides professional window treatment services including:

  • In-home consultations and measurements
  • Custom window treatment design and recommendations
  • Product sourcing and ordering
  • Professional installation of blinds, shades, shutters, and related products
  • Post-installation support and service

All services are subject to availability and scheduling constraints.

3. Estimates and Quotes

Free in-home estimates are provided for informational purposes and are valid for 30 days from the date of issue. Final pricing may vary based on:

  • Changes to project scope or specifications
  • Product availability and manufacturer pricing changes
  • Site conditions discovered during installation
  • Additional services requested by the Customer

We will notify you of any significant price changes before proceeding with work.

4. Payment Terms

4.1 Deposit: A 50% deposit is required upon acceptance of the quote to begin processing your order. This deposit secures your place in our production and installation schedule.

4.2 Final Payment: The remaining 50% balance is due upon completion of installation, unless otherwise agreed in writing.

4.3 Accepted Payment Methods: We accept cash, check, credit/debit cards, and electronic payments. A convenience fee may apply to credit card transactions.

4.4 Late Payments: Accounts not paid in full within 30 days of the invoice date may be subject to a late fee of 1.5% per month (18% annually) or the maximum rate permitted by law, whichever is less.

4.5 Custom Orders: Deposits for custom-ordered products are non-refundable once the order has been placed with the manufacturer.

5. Scheduling and Installation

5.1 Timeline: Installation timelines are estimates based on current production schedules and may vary due to factors beyond our control, including product availability and manufacturing delays.

5.2 Rescheduling: Customers may reschedule installation appointments with at least 48 hours’ notice. Cancellations or rescheduling with less than 48 hours’ notice may incur a rescheduling fee of $75.

5.3 Access: Customer agrees to provide clear access to all windows where installation will occur and to ensure someone 18 years or older is present during installation.

5.4 Site Conditions: Customer is responsible for ensuring installation areas are prepared, including removal of existing treatments unless otherwise agreed. Additional charges may apply for unexpected site conditions requiring additional labor or materials.

6. Product Warranties

6.1 Manufacturer Warranties: Products are covered by manufacturer warranties which vary by brand and product type. Warranty details will be provided with your order and must be registered according to manufacturer requirements.

6.2 Installation Warranty: We warrant our installation workmanship for one (1) year from the date of installation. This warranty covers defects in installation but does not cover:

  • Normal wear and tear
  • Damage caused by misuse, abuse, or improper care
  • Damage from accidents, pets, or acts of nature
  • Products installed outside of manufacturer specifications
  • Modifications or repairs by parties other than The Blind Guyz

6.3 Warranty Claims: To make a warranty claim, contact us within 30 days of discovering the issue. We will assess the claim and determine appropriate resolution, which may include repair, replacement, or refund at our discretion.

7. Product Specifications and Colors

7.1 Color Matching: We make every effort to display accurate product colors, but actual colors may vary from samples, digital images, or displays due to lighting, screen settings, and manufacturing variations. We recommend reviewing physical samples before ordering.

7.2 Custom Products: Custom-made products are manufactured to your specifications and cannot be returned or exchanged unless defective. Please carefully review all measurements, colors, and specifications before approving your order.

7.3 Natural Materials: Products made from natural materials (wood, bamboo, etc.) will have natural variations in grain, color, and texture. These variations are not considered defects.

8. Cancellations and Returns

8.1 Order Cancellation: Orders may be cancelled before products are ordered from the manufacturer for a full refund minus a 10% processing fee. Once products are ordered, deposits are non-refundable.

8.2 Stock Products: In-stock, non-custom products may be returned within 14 days of delivery in original, unused condition for a refund minus a 25% restocking fee. Customer is responsible for return shipping costs.

8.3 Custom Products: Custom-made products cannot be returned or exchanged unless defective or not manufactured to agreed specifications.

9. SMS Text Messaging Services

9.1 Consent to Receive SMS Messages

By providing your mobile phone number and consenting to receive text messages from The Blind Guyz (either through our website contact form, Facebook/Meta lead forms, or by replying “YES” to our initial message), you agree to receive SMS text messages from us. You understand and agree that:

  • Text messages may include appointment confirmations, reminders, installation schedules, service updates, and customer service communications (transactional messages).
  • If you separately opt-in to marketing messages, you may also receive promotional offers, special discounts, and new product announcements.
  • Consent to receive SMS messages is not a condition of purchasing any goods or services from The Blind Guyz.
  • Message frequency varies based on your appointments and service interactions. Marketing messages (if opted-in) are sent no more than 4 times per month.

9.2 Message and Data Rates

Standard message and data rates may apply based on your mobile carrier’s plan. The Blind Guyz does not charge for SMS messages, but your wireless carrier may charge you for receiving text messages according to your phone plan. You are solely responsible for any charges from your mobile carrier.

9.3 Supported Carriers and Devices

Our SMS service is supported by major U.S. wireless carriers including AT&T, Verizon, T-Mobile, Sprint, and other participating carriers. The service may not be available on all carriers or in all geographic areas. Delivery of SMS messages is subject to carrier transmission limits and network availability. We are not liable for delayed or undelivered messages.

9.4 Opt-Out and Unsubscribe

You may opt-out of receiving SMS messages from The Blind Guyz at any time by:

  • Replying STOP, END, QUIT, or UNSUBSCRIBE to any text message from our SMS number
  • Contacting us at info@blindguyz.com or 470-775-5469
  • Updating your communication preferences through our customer portal (if available)

After you opt-out, you will receive one final confirmation message, and you will not receive further SMS messages from us unless you re-opt-in. Please note that opting out of SMS messages does not affect your ability to receive our services or communications through other channels (email, phone calls).

9.6 Phone Number Changes

You are responsible for notifying us if your mobile phone number changes. If your number is transferred to another person, you should opt-out of SMS messages before the transfer to prevent that person from receiving your messages.

9.7 SMS Service Modifications

We reserve the right to modify, suspend, or terminate the SMS service at any time without notice. We may also change the phone number from which we send messages. Such changes do not require your consent but will be communicated when practicable.

9.8 No Liability for SMS Content

While we make reasonable efforts to ensure SMS messages are accurate and timely, we are not liable for:

  • Errors or inaccuracies in message content
  • Delays in message delivery due to carrier or network issues
  • Undelivered messages due to phone being turned off, out of service area, or blocked by spam filters
  • Messages received by unintended recipients if you do not update your contact information

9.9 SMS Records and Compliance

We maintain records of SMS consent, message history, and opt-out requests in compliance with the Telephone Consumer Protection Act (TCPA) and FCC regulations. These records are retained for a minimum of 4 years.

9.10 International Messaging

Our SMS service is designed for U.S. phone numbers only. International messaging may not be supported, and additional charges may apply if you are traveling internationally or using an international phone number.

10. Limitation of Liability

10.1 Service Limitations: Our liability is limited to the repair, replacement, or refund of defective products or services as outlined in our warranty. We are not liable for indirect, incidental, special, or consequential damages.

10.2 Maximum Liability: In no event shall our total liability exceed the amount paid by Customer for the specific product or service giving rise to the claim.

10.3 Property Damage: While we take care to protect your property during installation, Customer should remove or protect valuable or fragile items in work areas. We maintain general liability insurance but are not responsible for pre-existing damage or issues not directly caused by our installation work.

10.4 Pets and Children: Customer is responsible for securing pets and supervising children during installation. We are not liable for injuries or damages resulting from unsecured pets or unsupervised children.

11. Customer Responsibilities

Customer agrees to:

  • Provide accurate measurements and specifications if conducting own measurements
  • Disclose any structural issues, concerns, or special requirements before installation
  • Ensure installation areas are accessible and clear of obstacles
  • Provide adequate lighting and electrical outlets if needed for installation
  • Follow product care and maintenance instructions provided by manufacturer
  • Inspect products upon delivery and notify us immediately of any damage or defects
  • Comply with all applicable HOA, building, and local regulations regarding window treatments
  • Keep contact information (including phone number and email) current and accurate
  • Notify us promptly of any changes to your mobile phone number

12. Intellectual Property

All designs, proposals, quotes, and other materials created by The Blind Guyz remain our intellectual property. These materials may not be used with other service providers or reproduced without our written consent.

13. Privacy and Data Protection

We collect and use personal information in accordance with our Privacy Policy. By using our services, you consent to our collection and use of information as described in the Privacy Policy, available at theblindguyz.com/privacy-policy.

14. Photography and Marketing

Unless you opt out in writing, we may photograph completed installations for marketing purposes including our website, social media, and promotional materials. We will not identify you by name or address without your express permission.

15. Dispute Resolution

15.1 Good Faith Resolution: We are committed to customer satisfaction. If you have concerns about our products or services, please contact us directly so we can work toward a resolution.

15.2 Governing Law: These Terms of Service are governed by the laws of the State of Georgia without regard to conflict of law provisions.

15.3 Jurisdiction: Any disputes arising from these terms or our services shall be resolved in the courts of Coweta County, Georgia.

15.4 Arbitration: For claims under $10,000, parties agree to binding arbitration in accordance with the rules of the American Arbitration Association before pursuing litigation.

16. Safety Warnings

16.1 Child Safety: Corded window treatments can pose a strangulation hazard to children. We strongly recommend cordless or motorized options for homes with young children. If corded products are chosen, Customer assumes all responsibility for proper use and supervision.

16.2 Installation Safety: Customer acknowledges that improper installation or modification of window treatments can create safety hazards. Modifications or repairs should only be performed by qualified professionals.

17. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.

18. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website with a new “Last Updated” date. Your continued use of our services following any changes constitutes acceptance of the modified terms. For material changes affecting SMS communications, we will notify you via text message or email.

19. Entire Agreement

These Terms of Service, together with any written quotes, proposals, or service agreements, constitute the entire agreement between Customer and The Blind Guyz regarding our services and supersede all prior agreements and understandings.
